1.2 By accessing or using the Site, creating an account, or placing an order, you (“customer”, “you”, “your”) agree to be bound by these Terms & Conditions (“Terms”).

1.3 These Terms operate alongside your statutory rights under the Australian Consumer Law (ACL) and cannot exclude or limit those rights.

1.4 We may amend these Terms from time to time to reflect changes in law, technology, or business operations. Updated Terms will be posted on the Site and apply from the date of publication.

4. Orders and Contract Formation

5. Pricing, GST and Charges

5.2 Prices include Goods and Services Tax (GST) where applicable.

5.3 The total amount payable, including GST and Delivery Fees, is displayed at checkout.

5.4 International customers are responsible for any import duties, local taxes, and customs fees not included in the order total.

5.5 We reserve the right to modify pricing, delivery fees, or promotional offers at any time.

6. Payment

7. Delivery and Risk

7.1 We ship primarily via Australia Post, offering standard, express, and promotional shipping options.

7.2 Estimated timeframes:

• Standard Post, Same State, 2-3 days (2 for capital/metro, 3 for rural)

• Standard Post, Interstate 2-5 days (2-3 for capital/metro, 4-5 for rural)

• Express Post, Same State, 1-2 days (1 for capital, metro, 2 for rural)

• Express Post, Interstate, 1-3 days (1-2 for capital, metro, 2-3 for rural)

• International (NZ, UK, USA): 7–21 business days depending on customs clearance.

7.3 Title passes upon receipt of full payment. Risk transfers to you once the order leaves our warehouse.

7.4 We are not liable for delivery delays beyond our control, including customs clearance or third-party courier delays.

7.5 Free shipping thresholds and flat-rate options are available as advertised.

8. Cancellations

8.1 You may cancel your order prior to dispatch by contacting info.styles@handkstyles.com.

8.2 Once dispatched, the order cannot be cancelled and must follow our Returns Policy.

8.3 H&K Styles may cancel orders where stock is unavailable, errors occur, or payment cannot be processed, and will issue a full refund accordingly.

9. Price Matching

9.1 We may, at our discretion, offer price matching where:

(a) the product is identical in brand, style, size, and colour;

(b) the competitor is a registered Australian or New Zealand business; and

(c) the product is in stock and publicly available.

9.2 Verification (e.g., URL and screenshot) is required.

9.3 Successful matches are credited as our online retail store credit for the price difference.

9.4 Price matching is not available for clearance sales, loyalty discounts, or past purchases.

10. Promotions and Discounts

10.1 All promotions, vouchers, and discount codes are subject to these Terms and any promotion-specific conditions displayed on the Site.

10.2 H&K Styles reserves the right to withdraw or modify promotions at any time without notice.

10.3 Sale items discounted by 50% or more are Final Sale and not eligible for return or exchange unless faulty under ACL.

11. Returns, Refunds and Consumer Rights

11.1 Our Returns Policy complies with the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)).

11.2 You are entitled to a repair, replacement, or refund if a product is faulty, not as described, or unsafe.

11.3 For change-of-mind returns, items must be:

• Returned within 7 days of delivery;

• Unworn, unwashed, and unused with tags intact; and

• Accompanied by proof of purchase.

11.4 Underwear bottoms, intimates, and swimwear cannot be returned for hygiene reasons unless faulty.

11.5 Return postage for change-of-mind is at your expense. H&K Styles covers shipping for faulty or incorrect items.

11.6 Refunds are processed to the original payment method within 5–10 business days after inspection.

12. Customer Accounts and Data Retention

12.1 Customers may shop via guest checkout or by creating an account.

12.2 You must provide accurate and current information and keep login details secure.

12.3 Under the Corporations Act 2001 (Cth) s286, H&K Styles must retain accurate financial and transaction records for 7 years.

12.4 We store order and customer data for legal, warranty, and accounting purposes, and destroy or de-identify personal information once it is no longer required, consistent with the Privacy Act 1988 (Cth) and Australian Privacy Principles (APP 11).

12.5 Customers should retain proof of purchase, as required by the ACL (receipts for items $75+ and upon request for smaller purchases).

13. User-Generated Content

13.1 By submitting photos, reviews, or tagging H&K Styles on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use that content for promotional or marketing purposes.

13.2 You warrant ownership of the content and indemnify us against third-party claims.

13.3 You may revoke consent by emailing info.styles@handkstyles.com, and we will remove the content promptly.

(c) Customers are responsible for ensuring products are suitable for their intended purpose.

15.3 H&K Styles’ liability is limited to:

(a) the replacement or repair of the product; or

(b) a refund of the purchase price paid.

16. Indemnity

You agree to indemnify and hold harmless H&K Styles, its employees, and affiliates from any claims, damages, or expenses arising from:
